EMPLOYERS USE THE FIXED-TERM CONTRACTS TO MANIPULATE WITH THE EMPLOYEES, AND FOR DECREASING RIGHTS DETERMINED IN THE LABOR RELATION

The regulation of the duration of fixed-term contracts was one of the main problems in the negotiations of the social partners so far in the procedure for adoption of a new Law on Labor Relations, which began in 2018.

The Federation of Trade Unions of Macedonia constantly points out that indefinite contracts are a rule in labor relations, they are a condition for quality of work, motivation and loyalty to the company, and all this is a prerequisite for achieving greater labor productivity and profit in the company that is in the interest of employers, but at the same time for workers means security, safety and a promising way of planning life and family development.

Employers should know that all over the world fixed-term contracts are the exception, not the rule; they are applied for temporary and occasional work tasks in certain conditions determined by law (replacement of an absent worker, increased workload, etc.), as well as for occasional performance of works that are not from the basic activity of the company.

Therefore, SSM strives for these agreements to be limited and with a duration of up to one year under certain conditions provided by law, ie to be adopted in the presence of real, objective conditions and needs of the work process.

Practice has shown that employers use these contracts to manipulate workers, reduce their employment rights for fear that the contract will not be extended and terminate employment contracts without determining real reasons for termination.

Often employers in negotiations advocate for the possibility of concluding fixed-term contracts without any legal restriction  and conditions, as well as advocating for them to be concluded for work that lasts three or more years, in fact employers advocate for the possibility for rapid dismissal of workers at their own subjective discretion, without cause or fault of the employee, without real basis and established factual situation and without any obligations and responsibilities.

In this way, the workers are put in a seriously subordinate position, which violates their human rights.

Workers 'rights are  significant part of human rights, SSM takes serious care of their realization, protection and promotion, and we will not allow reduction of workers' rights, derogation of the law and legal uncertainty for workers.

Members of the Parliament  to be encouraged and accept a proposal which means reducing the duration of fixed-term contracts to one year or 6 months, as the proposal of the parliamentary group of Levica   in Parliament and to contribute to the elimination of abuses committed by employers with employment contracts of fixed-time.

This kind of agreements during the pandemic crisis were used by employers for dissmisal workers.
