Today, the first hearing was held following the Lawsuit of the Federation of Trade Unions of Macedonia filed against the Government for protection against discrimination in the public interest. The Union of Trade Unions of Macedonia at today's hearing represented and represented the workers at the highest level through the President of SSM, Darko Dimovski, the Secretary of the Council of SSM Zlatko Cvetkovski, the President of UPOZ, Trpe Deanovski, the President of SGIP Ivan Peshevski and others, and for unfortunately, not a single representative of the Government, nor the prime minister nor any minister who receives a salary precisely from the taxes of the workers dared, did not take courage and did not appear at today's hearing to explain what they have against the wages of the workers and against the workers, but how authorized representative they sent a junior associate from the Ombudsman (without proper power of attorney) who unfortunately has a salary of 22,000 denars and whose salary has not been adjusted to the increase in the minimum wage and who is equally discriminated against as his other colleagues and colleagues from the public sector, and he should defend the Government precisely for the discrimination that it first committed against him and against all public sector employees.
The lawsuit was filed in accordance with Article 35 of the Law on Prevention and Protection from Discrimination, especially because this law applies to employees from the public sector and in connection with work and labor relations, for employees in the public sector who are of different origins nationality and ethnicity, sex, gender, education, political affiliation, other belief, disability, age, social status, and any other discriminatory basis, considering that about 138,000 workers in the public sector were treated differently in the recruitment and the payment of wages and in conditions when it comes to jobs that require the same type and degree of education, the same work experience, the same scope and conditions for performing work tasks, and thus the principle contained in international documents that for work of equal value and equal work tasks should receive equal pay, which is not the case with the actions of the Government and its representatives.
By the action or non-action of the Republic of North Macedonia, the Government of the Republic of North Macedonia discriminated against a large number of employees in the public sector, that is, with the action of the defendant, a large number of workers were discriminated against, with which the Government violated the principle of equality of citizens and workers, which is regulated in Article 9 of the Constitution by not harmonizing the salaries of employees, and where it does, it does so without any objective conditions and criteria according to the personal wishes of certain ministers.
Of particular importance in terms of discrimination in the adjustment and increase of salaries is that for the position of State Counselor in a ministry of a different gender, different ethnicity, different political belief, different age, and social status will receive an adjustment to the minimum salary and an increase in the salary by 30% compared to his colleague in the position of State Counselor in another ministry of a different gender, different ethnicity, different political belief, different age, social status will not receive compliance with the minimum wage and salary increase, and the same are also applies to job positions that are the same in all ministries, such as head of the department, advisor, senior associate, independent officer, etc., as specified in the Law.
Therefore, Plaintiff SSM believes that due to the fact that it is about the same type of work tasks, the executors are paid different wages and not all wages are equal to the minimum wage, the impression is created that some employees are discriminated against because of national and ethnicity, sex, gender, education, political affiliation, other belief, disability, age, social status, and any other discriminatory basis.
Ministers and the Government continue today to create social anarchy and legal uncertainty by passing and repealing laws when they want and how they want, they decide for themselves whether to implement them or not, and instead of harmonizing lower rights with higher rights of workers, they reduce more favorable rights less favorable rights and at the same time knowingly commit crimes, for which we will file criminal charges.
We continue to fight in the coming period for workers' wages, both legally and in any other way, and workers and unions should unite in a common front like never before against this attitude of paid government officials.
