In connection with today's session of the Constitutional Court, the Federation of Trade Unions of Macedonia appeals to the Constitutional Court to support what was agreed between the social partners - that Sunday is a non-working day for the largest number of workers, except for the activities that the social partners determined as exceptions due to the necessity of continuous development of certain production processes.
The Constitutional Court is obliged to base its decision on national laws and international labor standards that are part of the national legislation, as well as to take care of the equal position of workers and citizens in the state without discrimination and with full respect for human rights.
We remind you that the abstract of this case was not to initiate proceedings, which means the Law on Amendments and Additions to the Law on Labor Relations, which regulates the right for Sunday to be a non-working day to remain in the legal order and for Sunday to remain a non-working day, and we expect this essay, this time to be unanimously supported by all constitutional judges, bearing in mind that the previous time the decision was not made due to the necessary quorum, but 4 constitutional judges supported the essay.
The position of workers is regulated through the social dialogue of all stakeholders in society, with laws and collective agreements aimed at the continuous improvement of workers' rights. In no case, the rights of an employment relationship in democratic states must not and cannot be created only on the basis of the will and demands of those employers who are motivated only by their desire for greater profit, without taking care to realize labor and human rights.
The Union of Trade Unions of Macedonia, as a representative trade union and national social partner in the country, was the initiator and the biggest supporter of the legal changes that make Sunday a non-working day for the largest number of employees in the country. The workers are already feeling the benefit of this right, the day of weekly rest should be Sunday, which is regulated in the laws (ZRO, Trade Law) which is fully in accordance with the provisions of the Constitution of the Republic of North Macedonia which stipulates that every employee has the right to paid weekly and annual leave and that from that right workers may not waive and employers may not limit.
Due to all this, we call on the Constitutional Court not to accept the initiative of the Chamber of Commerce as contrary to the Constitution and to leave in force the provisions of the legal decisions that make Sunday a non-working day for the largest number of workers and thus contribute to strengthening the legal order and the legal security of workers and citizens in the country.
