INFORMATION RELATED TO THE ADOPTED AMENDMENTS IN THE MINIMUM WAGE LAW

The Federation of Trade Unions of Macedonia has submitted opinions and remarks to the Economic and Social Council during the preparation of the Draft-Law on Amending the Law on Minimum Wage in the Republic of Macedonia, and also has sent official letters to the Ministry of Labor and Social Policy and the Ministry of Finance in which CCM disagrees with the proposal contained in Article 1 of the Draft Law on Amending the Law on Minimum Wage referring to Article 2 of the Law on Minimum Wage, proposing to add three new paragraphs defining the term “performance per output" after paragraph 1 (from Article 2 in the Law).

CCM proposed Article 2 of the Draft Law on Amending the Law on Minimum Wage to read as following:

The minimum wage is the lowest monthly amount of the basic salary, which the employer is obliged to pay to the employee for full time work.

CCM does not agree that the minimum wage should be conditioned by - a performance per output for which the proposed amendments to the Law, which have already been adopted by the Parliament of the Republic of Macedonia, are foreseen to be determined solely by the employer and based on criteria determined only by the employer.

The Federation of Trade Unions of Macedonia expressed its disagreement with a written letter to the Ministry of Labor and Social Policy and the Ministry of Finance on September 6, 2017, in the period when the draft law was in a discussion phase in the Parliament of the Republic of Macedonia.

Additionally, the Acting President of CCM, Darko Dimovski on an unofficial meeting with the President of the Government of the Republic of Macedonia, Zoran Zaev expressed the position of the Presidency of CCM, that the Federation of Trade Unions of Macedonia does not agree the minimum wage to be conditioned by - performance per output. Also, the President of CCM at the meeting with the President of the Government of the Republic of Macedonia noted that all negotiations regarding the amendments to the Laws in the field of labor legislation should be made exclusively with the Social Partners – the Trade Unions and employers' organizations.

The Federation of Trade Unions of Macedonia in the next period will submit an initiative for assessment of the constitutionality of the legal solution by conditioning the Minimum Wage with a performance per output, which will refer to Article 1 of the Draft Law on Amending the Law on Minimum Wage adopted by the Parliament of the Republic of Macedonia.

In addition to this information, we also attach the letters that CCM addressed to the MLSP and to the Ministry of Finance.
