OPENED PRE-BANKRUPTCY PROCEDURE OF AD BETON-SKOPJE

The Basic Civil Court Skopje, on the proposal of the Trade Union for Construction, Industry, and Design of the Republic of Macedonia - SGIP and the trade unionists and workers from DG Beton AD Skopje, on 01.11.2022, passed a Decision initiating a preliminary procedure to examine the conditions for opening bankruptcy proceedings of the debtor DG BETON AD Skopje.

With the Decision, a general ban on the disposition of the debtor's property is DETERMINED, the determination or implementation of enforced execution or security against the debtor is PROHIBITED, payments from the debtor's accounts are PROHIBITED, the debtor's debtors are CALLED to fulfill their obligations, etc.

Acting on the proposal for opening bankruptcy proceedings, the court assessed that in this particular case, the conditions for initiating bankruptcy proceedings are met.

With this adopted Decision, the bosses are no longer bosses and they, like the workers, will now have to wait for someone else, in the case of the temporary bankruptcy trustee, to give them their consent and decide on their behalf, and the workers and trade unions, together with the SGIP union at SSM, expect a big efficiency and responsibility on the part of the temporary bankruptcy trustee and the court in dealing with the matter and protection of their interests as creditors.

We appeal to all workers and creditors in the coming period to join the procedure and inform themselves at the Basic Civil Court Skopje, and in the coming days, the union SGIP will inform the members of the union how to fulfill their claims from DG BETON AD Skopje.

As a reminder, the employer DG Beton AD Skopje owes the workers six unpaid gross salaries, and vacation pay for 2021 and 2022, and its accounts have been blocked for more than 45 days, which was the main reason for the workers to exercise their rights in court.

Also, instead of this year in the month of December, the employer together with the workers celebrated the anniversary of 75 years of existence, the company went bankrupt due to bad management, despite all the efforts of the Union to find a solution for the situation in which the workers find themselves.
