I am surprised and concerned from your reaction stated in the letter that you have sent to the Prime Minister of the Government of the Republic of Macedonia and to the Minister of Labourand Social Policy of the Republic of Мacedonia on the 16th of August. Your reaction is based on a unilateral notification by former President Zivko Mitrevski dismissing all of the material evidence and facts that led to his lawful dismissal as President of Federation of TradeUnions of Macedonia(ССМ).
I want to inform and assure you that Zivko Mitrevski has been revoked as President of ССМ in accordance with the Statute of ССМ ona session of the CCM’s Council which is the highest body between two congresses. The session of the Council took place on November 13, 2016 and majority of Council members took part in it which is certified by signatures of every Council member that was present at the session.
On the basis of that session of the CCM Council, then appointed Technical Minister of Labor and Social Policy issued a Decision with which it changed the person authorized to represent CCM i.e. Darko Dimovski was registeredas new ССМ president. The Central Registry of the Republic of Macedonia did not act according to the laws and blocked the process of registering Darko Dimovski as president of SSM in their register which allowed the whole procedure to be used as a confrontation between the political parties.The scenario of the then Government and Zivko Mitrevski was to prevent the registration of the new President Darko Dimovski into the Central Registry of the Republic of Macedonia and the whole process to be handed over to court labyrinths.
You have to bear in mind that according to the EU report regarding the courts and the judiciary system in the Republic of Macedonia, is that the courts and the judiciary system were controlled and influenced by the then ruling political party. Zivko Mitrevski did not appeal the Decision of the Minister of Labor and Social Policy which made that Decision executive.
With the arrival of Mr. Ibrahim Ibrahimi as minister of labor and social policy (who was a minister of the former government), he immediately annulled the Decision of the previous Minister for which he received a criminal charge.
If there are any contraventions in Article 3 of ILO Convention No 87 I assure you that the contraventions were done by then Minister Ibrahim Ibrahimi with the help of Zivko Mitrevski and those contraventions resulted with chaos in the trade union movement in the Republic of Macedonia.
In the period when the Minister of Labor's Decision was annulled by Ibrahim Ibrahimi, Zivko Mitrevski took actions contrary to the SSM Statute and to the Laws and excluded 4 branch Trade Unions from SSM with the help of the then government.
With the arrival of the new Government, the initiators, i.e. 4 BranchTrade Unions SIER, UPOZ, SUTKOZ and AGRO, called for a reception with the new Minister of Labor and Social Policy and requested to annul the Decision of Minister Ibrahimi because it is not according to the Statute of SSM.
After detailed analysisand examination of the submitted evidence and documentation, the new Minister of Labor and Social Policy annulled the Decision of Ibrahim Ibrahimi, which opened the room for the Central Registry to be able to register the legitimately elected acting president of CCM Darko Dimovski as a person authorized to represent SSM and as acting President od ССМ according to the Statute of CCM he is obliged to convene an extraordinary Congress to elect new SSM President.
