Trendafilov clarifies for the newspaper VECHER that according to the European directives, fixed-time work should be an exception and it should be practiced only in the case of replacing an absent worker, for seasonal work, or an increased amount of work with a limited duration. With us, you can currently work for a fixed period of time for 5 years, and these are not temporary or occasional tasks. SSM stands for indefinite working hours or only one year of fixed-term work.
- The too-long fixed-term contracts and the unclear legal solution in practice proved to be a condition for the manipulation of the workers and an opportunity to cheat the workers' rights.
Employers use this legal solution to quickly issue dismissals without real reasons, without the obligation to implement a procedure, and pay severance pay. In practice, workers find it very difficult, almost not at all, to ensure the transformation of the employment relationship from fixed to an indefinite time, responds Trendafilov
The draft version of the new law on labor relations, which is in the stage of public discussion, has worried the workers in Macedonia. SSM, as the largest trade union and protector of their rights, reacts and points out that certain items of the law may be abused, to the detriment of workers' rights. The Ministry of Labor and Social Policy, as the drafter, says that the new law should harmonize labor rights in the country with those of the European directive. This legislation has been simmering for four years, and public hearings are currently taking place across the country where there is a reaction to certain changes. Most of the remarks come from the SSM, especially on the issue of fixed-time work. On that occasion, we spoke with Slobodan Trendafilov, head of the Office of the President of the SSM.
